Disrepair

If you are a Council or Housing Association tenant and your landlord has not carried out the necessary repairs in your home, you may be entitled to claim for disrepair.

If your accommodation needs repairs in relation to:

  1. Dampness;
  2. Mould;
  3. Fungus;
  4. Flooding;
  5. Leaks;
  6. Issues with your roof and gutters;
  7. Structural issues;
  8. Problems with your windows;
  9. Drainage issues;
  10. Pests, rodents;
  11. Asbestos;
  12. Electrical problems;
  13. Condensation and Ventilation;
  14. Central Heating and Boiler;
  15. Or anything else which is defective within your property which is the responsibility of your local authority;

Ashton Ross Law can offer advice and assistance to help you make a claim against your Council or Housing Association.

This will not affect your tenancy conditions. Your relevant Housing Association, Council or social landlords have a duty to ensure that you live in accommodation which is of a decent standard and quality.

These duties are:

  • to ensure that you are provided with a safe electrical installation, they must also maintain this,
  • ensure that any damaged appliances are repaired, ensure repairs in connection with all gas appliances,
  • they must ensure that their facilities have running water,
  • they must maintain and ensure heating and a supply of hot water, and
  • faulty fire and smoke alarms must be rectified.

Our aim is to get the repairs fixed and ensure that you and your family live in a safe and habitable property. In assisting with your claim we may be able to obtain financial compensation for you and/or alternative accommodation.  

Due to changes in legal aid funding many Housing Association or Council tenants are unable to obtain legal assistance in disrepair claims. In order to assist you in your claim we will work with you on a ‘no win, no fee’ basis, meaning that we will conduct your case at no cost to you.

You can contact us Monday to Friday 10:00am to 17:00pm to discuss your claim. We will provide you with free advice and in order to progress with your claim we will request images of the conditions of your property and the repairs needed. Following this, we will conduct an inspection of your property in order to determine the details of your case. We will complete all necessary paperwork with you in your home.
