Human Rights

Most people are aware of the association between the term “human rights” and immigration but few individuals fully understand the impact that human rights law can have on their individual case.

Article 8 of the Human Rights Act 1998 provides individuals with the right to a “private and family life”.

Ashton Ross Law are experts in human rights applications and appeals because we fully understand how the system works and we formulate effective strategies that are unique to each client. We like to keep our approach in human rights cases straightforward and simple and often use the spider and web analogy to help our clients understand what human rights are and how they work.

The Garden Spider and the Web

spider webImagine a spider who wants to move from one garden to another.
When the spider finds a suitable place, it begins the process of establishing a home and starts to spin a web. All webs begin with a single thread.

The spider is most vulnerable when it spins the first thread because during this stage, it is not secured. The spider is open to the elements and can easily be blown away by the wind and rain. It is easy to remove a spider which is on a single thread.

Over the course of time however the spider weaves more and more threads and eventually a complete spider web is formed. Once the web is complete, the spider has a secure home which is able to better withstand the elements. It is significantly harder to remove a spider which has established a larger and more secure web.

Just like the spider, when a person moves to another country, they usually have a limited number of connections (or threads). Over the course of time, that person will develop more connections and eventually they will become rooted.

When a person has a limited number of connections, it is easier for them to move or relocate but generally the more connections an individual has, the more difficult it is for them to move.

These connections that we develop form part of our private and family lives.

Removing an individual who has strong or a significant number of connections will usually breach their right to a private and family life.
